Terms of Service

By paying for a commission, you (the Commissioner) acknowledge to have read and agree to the Terms of Service. The Terms of Service are subject to change at any time.Artwork and assets will be created to the best of my (the artist, xMicchan's) abilities.The commissioner, who is of legal age, will receive a digital copy of the commissioned artwork, unwatermarked and in full resolution. There is no physical product.I have the right to decline a commission for any reason. Any ill behavior will not be tolerated and your commission will be cancelled and refunded if it occurs.Any part of the Terms of Service can be changed upon discussion.

Once the commission is approved, go ahead and provide the details of your commission, provide clear references, and pay for the commission.

PaymentAll payments will be done through PayPal in USD.Full upfront payments are required, unless otherwise agreed upon.Please wait until a PayPal invoice is sent. Any other payment not agreed upon or discussed will be considered a donation and non-refundable.Invoices must be paid within 72 hours, or the commission may be cancelled.Once the commission has been paid, progress on your commission will begin.If major revisions were requested, another payment via PayPal will be sent before sending the final product.The commissioner will not receive the full resolution files until the payment is completed.

Process & DeliveryA commission may take up to 1-2 weeks or up to 1-2 months to be completed depending on factors such as the type of commission, complexity, health, family issues, etc. If any of these occur, you will be notified as soon as possible. If the commission is unable to be completed, you will be notified about how we can move forward.You will receive a WIP:
- When the sketch is done
- When the lineart is done
- When the flat colors are done
- When you request minor changes (e.g. testing different eye colors)
- If I wonder something about the commissionAfter a WIP is sent, confirmation is required to proceed if everything is good, otherwise provide feedback on elements to fix. WIP will be smaller resolution with a watermark.You are allowed to post WIP on social media, but must credit me. The commission WIP is not allowed to be edited or transformed in any way without my knowledge and/or permission.The completed commission will be delivered in digital form only via Discord, google drive or email attachment. Google drive files might become unavailable to download after some time due to storage use, but will remain saved and accessible upon request.

RevisionsDuring the sketching phase, up to 3 sketch ideas are allowed. Each sketch after will be 10% of the total price of your commission.For each WIP sent, changes are allowed and encouraged. Please keep changes relevant to the WIP stage (changing character pose during sketching phase, changing colors during the coloring phase, etc).Each major revision after the sketching phase will be an additional fee of 15% of the total price of your commission. Major changes require me to completely redraw any part of the artwork including, but not limited to: outfit changes, background changes.After a commission is complete, only minor changes are allowed such as coloring or marking mistakes, within two weeks of the commission's completion.Completed commissions are not allowed to be edited or tranformed in any way without my knowledge and/or permission.

Copyright & Usage PolicyArtist Rights
The artist (xMicchan) retains original copyright, ownership, redistrubution, and intellectual property rights of the artwork, unless otherwise agreed upon. This includes but is not limited to display, advertising, printing, the artwork and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch), etc.The artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the Commissioner's IP rights and ownership of their likeness, character design, branding, identity, design or any such trademarks.The artist retains non exclusive rights to sell merchandise and prints of their artwork, unless exclusive commercial rights are purchased by the commisioner.Commissioner Rights
The commissioner is allowed to use the artwork for personal use only, unless otherwise agreed upon. This includes but is not limited to display on social media for promotional purposes with no monetization, such as profile pictures, banners, and posts; print and framing for personal use; display as part of designs on websites and channels, excluding use in content of these websites of channels.The commissioner may not use rejected sketches.The commissioner may not claim the artwork as their own and must credit the artist using their social tag/username/link at the instance of display of the artwork or permanently on their websites, social media profiles, broadcast channels and so on.Commercial Rights
Commercial rights are not included unless specified in the commission type or listing on the artist's websites (i.e. stream emotes, badges, bits, panels, overlays, etc.) or as agreed upon.Commercial rights may differ for each commission type. Commercial broadcast rights means usage of artwork on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling artwork to another party, as a part of any product or merchandising on another platform.In the case of original design work for the purpose and definition of the commissioner's brand identity such as character design, logo design, and more, IP rights of the designs and their likeless are exclusively granted to the commissioner for use, production and modification purposes, commercial or personal.Usage of artwork for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platform/purposes, is strictly prohibited.Additional charges will be required for commercial usage if not included.If the commissioner's rights and the terms of the agreement are violated or the artwork is not delivered as agreed, due to artist's negligence, the artist will work to remedy the situation first according to the terms aforementioned and otherwise to the satisfaction of the Commissioner.

Cancellation & Refund PolicyI have the right to cancel and refund your commission at any time.The commissioner can cancel the order prior to payment.Once the payment has been received and work on your commission has begun, you are no longer eligible for a refund, unless initiated by me and except for circumstances detailed in the Process & Delivery section.If I cannot complete the artwork or there are delays as detailed in the Process & Delivery section for unforeseen reasons, the commissioner may be eligible for a full refund. If work done up to this point is accepted by the commissioner, the artist will provide a partial refund according to the amount of work completed.Do not request a PayPal chargeback. The money will be transferred back to you.If a PayPal chargeback is requested at any point, the commissioner loses all rights to the commissioned piece and the artist retains the full right to profit from it in any way. The chargeback will be declined and PayPal will be supplied with evidence about the commission. Furthermore, the commissioner will be blacklisted from commissioning ever again.
